  • 生态环境部:对守法记录良好企业将大幅减少监管频次

一、对群众投诉反映强烈、违法违规频次高的企业加密执法监管频次。小长期期间,生态环境部发布《关于进一步深化生态环境监管服务推动经济高质量发展的意见》(以下简称《意见》),对环境执法提出新的规范要求,同时出台了一系列新举措。

1. Encrypted law enforcement and supervision of enterprises with strong complaints from the masses and high frequency of violations of laws and regulations. In the short and long term, the Ministry of Ecology and Environment issued "Opinions on Further Deepening Eco-environmental Supervision Services to Promote High-quality Economic Development" (hereinafter referred to as "Opinions"), which put forward new normative requirements for environmental law enforcement, and issued a series of new measures.

《意见》要求,发布生态环境保护综合行政执法事项指导目录,进一步规范行政检查、行政处罚、行政强制行为。同时,根据环境影响程度,合理设置“双随机”抽查比例,及时公开抽查情况和抽查结果。

The Opinions require that a directory of comprehensive administrative law enforcement matters for ecological environment protection be issued to further standardize administrative inspections, administrative penalties and administrative compulsory acts. At the same time, according to the degree of environmental impact, the proportion of "double random" spot checks should be set reasonably, and the situation and results of spot checks should be made public in time.

生态环境部提出,2020年年底前,各级生态环境部门实现“双随机、一公开”监管常态化,全面推进行政执法公示制度、执法全过程记录制度、重大执法决定法制审核制度。依托在线监控、卫星遥感、无人机、移动执法等科技手段,优化非现场检查方式,建立完善风险预警模型,推行热点网格预警机制,提高监督执法的精准性。

The Ministry of Ecology and Environment has proposed that by the end of 2020, ecological and environmental departments at all levels should normalize the supervision of "double random and one open", and comprehensively promote the publicity system of administrative law enforcement, the record system of the whole process of law enforcement and the legal review system of major law enforcement decisions. Relying on on-line monitoring, satellite remote sensing, UAV, mobile law enforcement and other scientific and technological means, optimize off-site inspection methods, establish and improve risk early warning model, implement hot grid early warning mechanism, improve the accuracy of supervision and law enforcement.

二、值得关注的是,《意见》要求健全宽严相济执法机制。生态环境部将出台关于做好引导企业环境守法工作的意见,让守法企业获得市场竞争优势,让违法企业付出高昂代价。“定期评定并发布生态环境守法‘标杆企业’名单,对守法记录良好的企业大幅减少监管频次,做到对守法者无事不扰。”《意见》说,对群众投诉反映强烈、违法违规频次高的企业加密执法监管频次;对案情重大、影响恶劣的案件,联合公安机关挂牌督办;推进生态环境行政执法与刑事司法衔接,依法严厉打击环境犯罪。将环保信用信息纳入全国信用信息共享平台,针对环境失信企业和自然人,实施联合惩戒。

"Regular assessment and publication of the list of"benchmarking enterprises"for ecological environment compliance, reduce the frequency of supervision to enterprises with good record of compliance, and do nothing to disturb law-abiding people." "Opinions" said that enterprises with strong complaints from the masses and high frequency of violations of laws and regulations encrypted the frequency of law enforcement and supervision; jointly with public security organs to supervise and handle serious cases; promote the link between ecological environment administrative law enforcement and criminal justice, and severely crack down on environmental crimes according to law. Integrate environmental credit information into the national credit information sharing platform, and implement joint punishment for environmental dishonest enterprises and natural persons.

生态环境部要求,各地市、县区级生态环境部门每月至少确定1天作为“服务企业接待日”,面对面解决企业的合理诉求和困难。建立政务服务“好差评”制度。建立政府失信责任追溯和承担机制。

《意见》强调,积极推动落实环境保护税、环境保护专用设备企业所得税、第三方治理企业所得税、污水垃圾与污泥处理及再生水产品增值税返还等优惠政策。推动完善污水处理费、固体废物处理收费、节约用水水价、节能环保电价等绿色发展价格机制,落实钢铁等行业差别化电价政策。

The Opinion stresses that preferential policies such as environmental protection tax, enterprise income tax on special equipment for environmental protection, enterprise income tax on third-party treatment, sewage waste and sludge treatment and value-added tax return of recycled aquatic products should be actively promoted. We will promote the improvement of green development pricing mechanisms, such as sewage treatment fees, solid waste treatment fees, water and electricity prices for water conservation and environmental protection, and implement differentiated electricity pricing policies for iron and steel industries.

三、对于民生领域的环境监管,生态环境部要求,坚持以供定需、以气定改、先立后破、不立不破,在确保群众温暖过冬的前提下推进清洁取暖,在改造完全到位并落实气源、电源之前,不得先行拆除群众现有取暖设施及装备。加强餐饮、洗染、修理等生活性服务业和畜禽养殖业的日常监督管理,对环境污染突出、群众反映强烈的,依法予以查处,避免“突击式”整治或关停。

3. For environmental supervision in the field of people's livelihood, the Ministry of Ecology and Environment requires that the existing heating facilities and equipment of the masses should not be dismantled before the transformation is fully in place and the implementation of air and power supply. Strengthen the daily supervision and management of catering, washing and dyeing, repairing and other domestic service industries and livestock and poultry breeding industries. If environmental pollution is prominent and the masses strongly reflect on it, it shall be investigated and dealt with according to law to avoid "sudden" rectification or closure.

《意见》特别提出统筹规范生态环境督察执法,严禁为应付督察不分青红皂白采取紧急停工停业停产等简单粗暴措施,以及“一律关停”“先停再说”等敷衍应对做法。对相关生态环境问题整改,坚持依法依规,注重统筹推进,建立长效机制,按照问题轻重缓急和解决的难易程度,能马上解决的不能拖拉;一时解决不了的,明确整改目标、措施、时限和责任单位,督促责任主体抓好落实。落实统筹规范强化监督工作实施方案,不增加地方负担,不干扰地方日常监督检查。完善问题审核标准和执法工作手册,进一步规范适用环境行政处罚自由裁量权,防止因某一企业违法行为或某一类生态环境问题,对全区域或全行业不加区分一律实施停产关闭。

The "opinions" put forward a comprehensive plan to standardize the supervision of the ecological environment inspectors, and strictly prohibit the simple and crude measures such as emergency shutdown, stoppage and shut-down and so on. The rectification of relevant ecological environment problems must be carried out in accordance with the law. We must adhere to the law, pay attention to overall planning, and establish a long-term mechanism. We can not solve the problem immediately according to the priorities and the difficulty of solving problems. We can not solve the problems of rectification, clarify the objectives, measures, time limits and responsibility lists, and urge the responsible parties to carry out the implementation. Implementing overall planning, standardizing and strengthening the implementation plan of supervision work, without increasing local burdens and interfering with local daily supervision and inspection. We will improve the standards for problem auditing and the Handbook for law enforcement, further standardize the discretion to apply environmental administrative penalties, and prevent the shutdown of production in the whole region or industry without distinction because of an enterprise's illegal activities or a certain kind of ecological environment problems.

生态环境部提出,重视并解决好企业对环境监管的合理诉求,坚决避免处置方式简单粗暴,坚决杜绝平时不作为、急时“一刀切”和应对督察执法考核时乱作为等形式主义、官僚主义突出问题。建立监督检查通报制度,切实解决一批企业、群众关心的实际问题
